The Foundry Box Pty Ltd (“The Company”) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how it manages your Personal Information.

The Company has adopted the Australian Privacy Principles (“APPs”) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why is it collected?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information the Company collects includes (but is not limited to) names, addresses, email addresses, phone, social handles and fax numbers. When the Company collects Personal Information it will, where appropriate and where possible, explain to you why we are collecting the information and how we plan on using it.

Use of Your
Personal Data

The Company collects your Personal Information for the primary purpose of operating our website and delivering our Services.

Marketing and Communications (Consent / Legitimate Interests): To  contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation. To help you maximize value, send updates,notices, invoices, and respond to inquiries. To inform you about new features, special offers, discounts, and promotional opportunities which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.

  2. For the Performance of a Contract (Legitimate Interests): the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

  3. Customer Support (Legitimate Interests): To assist with any issues and improve your user experience and to attend and manage your requests. 

  4. Analysis & Development (Legitimate Interests): To analyse usage data, improve our platform’s functionality, and ensure Services reliability and security.

  5. Human Resources (Consent / Legitimate Interests / Legal Obligation): For processing candidate applications, recruitment activities, and internal organisational planning.

  6. Legal Requirements (Legal Obligation): To comply with applicable laws, court orders, or regulatory requirements.

The Company may share your personal information in the following situations:

  • With Service Providers: The Company may share your personal information with service providers to monitor and analyse the use of our service, to show advertisements to you to help support and maintain our service, to advertise on third party websites after you visited our Service, for payment processing, to contact you.

  • For Business transfers: The Company may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.

  • With Business partners: The Company may share your information with its business partners to offer you certain products, services or promotions.

  • With other users: when you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a Third-Party Social Media Service, your contacts on the Third-Party Social Media Service may see your name, profile, pictures and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you and view your profile.

The Company may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from the Company’s mailing/marketing lists at any time by contacting us in writing. 

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. The Company does not use Sensitive Information in direct marketing activity. The Company’s direct marketing material will include a simple means by which you can request not to receive further communications of this nature, such as an unsubscribe button link

The Company generally does not collect Sensitive Information, but if it does Sensitive information will be used only:

•       For the primary purpose for which it was obtained.

•       For a secondary purpose that is directly related to the primary purpose.

•       With your consent; or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, the Company will collect your Personal Information only from you. However, in some circumstances the Company  may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party. These services have their own privacy policies. You can access the privacy policies on their respective websites. ​

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

 

The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Your Personal Data

Business Transactions: If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. The Company will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law enforcement: Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).


Other legal requirements: The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Protect and defend the rights or property of the Company

  • Prevent or investigate possible wrongdoing in connection with the Service

  • Protect the personal safety of Users of the Service or the public

  • Protect against legal liability

Security of Your Personal Data

The security of your Personal Data is important to the Company, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. Whilst the Company strives to use commercially acceptable means to protect your Personal Data, the Company cannot guarantee its absolute security.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

•       Third parties where you consent to the use or disclosure; and

•       Where required or authorised by law.

Overseas Transfer

Your Personal Information may be transferred to recipients located in the US, Canada and the EU where there are data protection laws which protect Personal Information in a way which is at least substantially similar to the APPs, and there will be mechanisms available to you to enforce protection of your Personal Information under that overseas law. In the circumstances, we do not require the overseas recipients to comply with the Australian Privacy Principles and we will not be liable for a breach of the Australian Privacy Principles if your Personal Information is mishandled.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

The Company will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information the Company may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is up to date. The Company  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update its records and ensure it can continue to provide quality services to you.

Privacy Policy Complaints and Enquiries

Where reasonable and practicable to do so, the Company will collect your Personal Information only from you. However, in some circumstances the Company  may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party. These services have their own privacy policies. You can access the privacy policies on their respective websites. ​

Transfer of Your Personal Data

If you have a complaint concerning the manner in which the Company maintains the privacy of your Personal Information, please contact us as on the contact details set out at the bottom of this policy. The Company may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. The Company will acknowledge receipt of your complaint within 14 business days and provide you with a reference number. The Company will investigate your complaint and maintain detailed records of all communications and findings. The Company aims to resolve all privacy complaints within 30 business days. If additional time is required, we will notify you in writing. All complaint documentation will be retained for 12 months following resolution. If the matter requires escalation, our Privacy Officer will personally review your case within 14 business days of the escalation request.

The Company strongly advises you to review the Privacy Policy of every site you visit. The Company has no control over and assumes no responsibility for the content, privacy policies or practices of any third party sites or services. of transmission over the Internet, or method of electronic storage is 100% secure. Whilst the Company strives to use commercially acceptable means to protect your Personal Data, the Company cannot guarantee its absolute security.
